1. Introduction
Welcome to getsocialaccord.com (the “Site”). The Site, together with the SaaS platform and related features accessed through it, is operated by Textoscopio, Lda, a Portuguese limited liability company with tax identification number (NIF) 516897985, having its registered office at Rua Cidade de Nampula, 148, 5-dto, 1800-105 Lisboa, Portugal (“Textoscopio”, “We”, “Us” or “Our”). Textoscopio refers to the Site and the platform and services provided through the Site, collectively, as the “Service”. The Service operates the Social Accord Architecture risk quantifier and related dashboards, reports, and downloads.
These Terms of Service (the “Terms”) set forth an agreement between You and Textoscopio governing Your access to and use of the Service. “You,” “Your,” or “User” refers to You as an individual who browses the Site or uses the Service. If You use the Service as an employee of or otherwise on behalf of an organisation or entity, the Terms also refer to and bind that organisation or entity.
By using the Service or submitting information to Textoscopio, You signify Your acceptance of these Terms to the maximum extent permitted by law. You may only use the Service if You are at least 18 years old. Please do not attempt to use the Service if You are younger than 18.
Textoscopio has the right to modify or update these Terms at any time. Material changes will be communicated by email or through the Site at least 14 days before they take effect. Your continued use of the Service following the effective date of updated Terms constitutes Your acceptance of the updated Terms. If You do not accept the updated Terms, You may cancel Your subscription before they take effect.
Textoscopio reserves the right to add, change, modify, suspend or discontinue all or any part of the Service at its sole discretion. Where a change materially reduces the functionality of a paid Tier, Textoscopio will give reasonable notice and, where appropriate, prorate or refund affected fees.

3. Account registration and security
To access most features of the Service You must register an Account. You may register by providing an email address (magic-link authentication), by using Google OAuth, or by setting an email and password.
You represent and warrant that all information You provide for purposes of using the Service will be true, accurate, current and complete. Failure to comply with this warranty constitutes a breach of these Terms and may result in immediate termination of Your Account. You shall promptly update Your Account information to keep it accurate and current, and maintain the confidentiality of Your password and authentication credentials.
You shall not (a) select or use the email address or user name of another person with the intent to impersonate that person, (b) use a name subject to the rights of any other person without authorisation, (c) use an email address or user name that is profane, offensive or otherwise inappropriate, or (d) allow any other party to use Your Account or credentials.
You agree to immediately notify Textoscopio of any known or suspected unauthorised use of Your Account or any breach of security, including loss, theft or unauthorised disclosure of Your password. You understand and agree that You shall be liable for all activities that occur under Your Account, even if such activities were not committed by You. Textoscopio is not responsible for any loss or damage arising from Your failure to maintain the confidentiality of Your credentials.
4. Subscriptions, pricing, and billing
4.1 Tiers
The Service is offered in four Tiers: Free (registered), Explorer, Portfolio, and Enterprise. Free (registered) Users may complete the Assessment and view preliminary results without payment. Explorer, Portfolio, and Enterprise are paid subscriptions with progressively expanded features as described on getsocialaccord.com/pricing.
4.2 Founding member rate
Textoscopio offers a discounted “founding member” monthly rate for early subscribers. The founding rate is locked for the duration of Your continuous subscription. If You cancel and re-subscribe after the founding window has closed, the regular rate applies. Textoscopio may close the founding window at any time without notice.
4.3 Billing and auto-renewal
Paid subscriptions are billed monthly in advance through our payment processor (Stripe). Subscriptions automatically renew at the end of each billing cycle until cancelled. By subscribing, You authorise Textoscopio (through Stripe) to charge the payment method on file at the start of each billing cycle. Portfolio subscribers may opt for annual billing at a discounted rate; annual subscriptions are paid upfront for 12 months and are non- refundable except as provided in Section 5.
4.4 Taxes
Prices are exclusive of VAT and other applicable taxes unless stated otherwise. For EU customers, applicable VAT will be calculated and added at checkout based on the customer location. You are responsible for any taxes, levies, or duties imposed by Your local jurisdiction.
5. Cancellation and refunds
5.1 Cancellation
You can cancel a paid subscription at any time from Your Account billing page. Cancellation takes effect at the end of the current paid period; You retain access to Your subscription Tier until then. After cancellation, Your Account reverts to Free (registered) and Your Project Data is preserved in read-only mode. Your Account and Project Data are permanently deleted 12 months after the later of the cancellation and Your last sign-in; We email You a warning at least 30 days before. Signing in or re-subscribing before then keeps them. See the Privacy Policy for details.
5.2 Money-back guarantee
Textoscopio offers a 30-day money-back guarantee on Your first paid subscription on an Account. If You are not satisfied, contact Us within 30 days of the first charge and We will refund the most recent month payment in full. The guarantee applies only to the first paid subscription on each Account.
5.3 Refunds outside the guarantee window
Outside the 30-day money-back window, payments are non-refundable except as required by mandatory consumer law. Consumers in the European Union retain statutory rights under Directive 2011/83/EU and applicable Portuguese consumer protection laws.
6. Proprietary rights and limited licence
You acknowledge and agree that, as between You and Textoscopio, Textoscopio and its licensors retain all right, title and interest in and to all data and information (excluding data and information You provide), content and materials provided on the Site, including, without limitation, text, images, graphics, page headers, other content, any trademarks, service marks and logos of Textoscopio (collectively, “Content”), the selection and arrangement of elements displayed on the Site, the Methodology and the business processes, procedures, methods and techniques used in the Service, and all associated patent rights, copyright rights, trademark rights, trade secret rights and other intellectual property and proprietary rights recognised anywhere in the world (“Intellectual Property”).
Textoscopio grants You a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for Your internal business use, subject to these Terms. You may not:
- remove any logos, trademark or copyright notices, or any other notice contained in any Content or element of the Site;
- reproduce, download, modify, publish, distribute, transmit, disseminate, broadcast, transfer, license, sell, rent, lease, adapt, create derivative works of, publicly display or perform, or in any way commercially exploit Content or Service without Textoscopio prior written consent (except (a) as otherwise expressly facilitated or indicated by Textoscopio, and (b) printing copies of individual screens on the Site as well as Content such as Your own report or roadmap export for Your internal personal or business use);
- use any circumvention tools or any metatags or other hidden text utilising the Textoscopio or getsocialaccord.com name, logo, URL, or the name of any feature of the Service without Textoscopio prior written consent;
- disassemble, decompile, reverse engineer, or attempt to derive the source code of the Service, the Methodology, or underlying software, except to the extent expressly permitted by law;
- use the Service to develop a competing product or service.
7. Methodology White Paper licence (paid subscribers)
Paid Tier subscribers (Explorer, Portfolio, Enterprise) receive access to the complete Methodology White Paper as a watermarked PDF. The White Paper is provided under the following terms, which form part of these Terms:
- Limited internal use only. The White Paper is licensed to the named subscriber for internal business use within the subscriber organisation. The subscriber may not share, distribute, redistribute, publish, or display the White Paper outside the subscriber organisation.
- No reproduction or derivative use. You may not reproduce, copy, adapt, translate, summarise, or create derivative works from the White Paper, in whole or in part, except for internal note-taking and quotation in good faith for legitimate business purposes within Your organisation.
- Watermarking and audit. Every White Paper download is uniquely watermarked with the subscriber email address, download timestamp, and a unique download identifier. Textoscopio logs each download. If a leaked or unauthorised copy is identified, Textoscopio may use this audit data to investigate and may pursue legal remedies against the originating subscriber.
- Acknowledgement. Before the first download, You must affirmatively acknowledge these terms in a click-through agreement. Subsequent downloads are subject to the same terms.
- Rate limit. White Paper downloads are limited to five (5) downloads per subscriber per rolling 30-day period.
- Breach. Distribution, reproduction, or derivative use of the White Paper without Textoscopio written authorisation constitutes a material breach of these Terms. Textoscopio reserves all rights to seek injunctive relief and damages, including any profits attributable to the unauthorised use.
- Termination of access. On termination of Your subscription, Your right to use the White Paper terminates. You must delete all copies in Your possession or control and confirm deletion if requested.
8. Use of the Service
You shall comply with all applicable laws, statutes, ordinances and regulations in Your use of the Service. Textoscopio may immediately terminate Your Account, or suspend Your access to Your Account, in its sole discretion and without notice, for conduct that Textoscopio believes is: (i) illegal, fraudulent, harassing or abusive, (ii) a violation of these Terms or any other policies or guidelines posted on the Site, or (iii) harmful to other Users, third parties, or Textoscopio business. Use of an Account for illegal, fraudulent or abusive purposes may be referred to law enforcement authorities without notice.
When using the Service, You agree to act reasonably and responsibly, and to use commercially reasonable efforts not to:
- upload, post, email, transmit, display on the Site or make available through the Service: (a) any information that is fraudulent, misleading, inaccurate, unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, pornographic, profane, invasive of another’s privacy, hateful, or otherwise objectionable, including any communication that constitutes (or encourages conduct that would constitute) a criminal offense, gives rise to civil liability or otherwise violates any applicable local, national, or international law or regulation; (b) any information that You do not have a right to make available under applicable law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information obtained as part of employment relationships or under nondisclosure agreements); (c) any information that infringes, violates, or misappropriates any patent, trademark, trade secret, copyright, privacy, publicity or other rights of any third party or entity; (d) any unsolicited or unauthorised advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other improper form of solicitation; or (e) any content or material that contains any virus, Trojan horse, worm, time bomb, bot or spider or any other computer code, files or programs designed to damage, interfere with, intercept, misappropriate, gain control over or limit the functionality of any computer, computer network, communications device, communications system, data or personal information;
- use the Service (i) to harm minors in any way, (ii) to impersonate any person or entity, or otherwise misrepresent Your affiliation with a person or entity, (iii) for any commercial purpose or the benefit of any third party in a manner not permitted by these Terms (resale, white-labelling, or running the Service for a third party requires separate written consent), or (iv) to violate any applicable local, national, or international laws or regulations;
- remove any proprietary notices from the Site;
- hack or seek unauthorised access to or compromise the integrity of the Site and Service (whether or not to obtain personal information), or breach or attempt to breach the security of the Site, Service and related servers and infrastructure, or attempt to disrupt the Service, servers or networks;

You acknowledge, consent and agree that Textoscopio may access, preserve and disclose Your Account information and Subscriber Content if Textoscopio is required to do so by law or if it believes in good faith that such access, preservation or disclosure is reasonably necessary to (A) comply with legal process, (B) enforce these Terms, (C) respond to claims that Subscriber Content violates the rights of third parties, (D) respond to Your requests for customer service, or (E) protect the rights, property or personal safety of Textoscopio, its employees, partners, agents or members of the public.
9. Subscriber Content and Project Data
9.1 Ownership
You retain all rights in Your Subscriber Content, including Your Project Data. Subscribing to the Service does not transfer ownership of Your data to Textoscopio.
9.2 Licence to Textoscopio
You grant Textoscopio a worldwide, non-exclusive, royalty-free licence to host, store, process, and display Your Subscriber Content solely to provide the Service to You and Your team members. The licence terminates when You delete the Content or close Your Account, subject to lawful retention obligations and to the de-identified aggregate use described in Section 9.3.
9.3 Aggregated and de-identified data
Textoscopio may use de-identified, aggregated data derived from Subscriber Content for product improvement, Methodology calibration, benchmarking, and research. Aggregated outputs do not identify You, Your organisation, or Your projects. Textoscopio will not publish or share project-level data without Your prior written consent.
9.4 Team members
Portfolio and Enterprise subscribers may invite team members. The subscriber is responsible for the conduct of invited team members and for ensuring they comply with these Terms.

The Site may contain links to other websites and resources. Such links are merely a convenience for Users, and the inclusion of any link does not constitute or imply any affiliation, recommendation, endorsement or sponsorship by Textoscopio of such websites or any content contained thereon. Textoscopio has no responsibility for any content, acts or omissions on such websites. You will need to review and observe the privacy policy and terms of use that govern Your experience on any third-party websites.
12. Warranty disclaimers

The Service is a screening and stratification tool. It relies on User-supplied inputs and probabilistic models calibrated against documented cases. The outputs are diagnostic and informational. Textoscopio does not verify the accuracy of Your inputs. Financial estimates, legal risk projections, and recommendations are probabilistic indications, not predictions. Actual outcomes depend on factors outside the Service scope.
Note. The Service does not create a lawyer-client relationship between You and Thomas Gaultier, Textoscopio, or any other person. Thomas Gaultier is a member of the New York Bar but the Service is not offered as a legal service or under legal privilege.
SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THE FOREGOING DISCLAIMERS MAY NOT APPLY TO YOU. YOU ACKNOWLEDGE AND AGREE THAT YOUR SOLE REMEDY FOR ANY PROBLEMS OR DISSATISFACTION WITH THE SITE OR THE SERVICE IS TO DISCONTINUE USE OF THE SITE AND THE SERVICE.
13. Limitation of liability
IN NO EVENT SHALL TEXTOSCOPIO OR ANY OF ITS DIRECTORS, OFFICERS, MEMBERS, EMPLOYEES, ASSOCIATES, AGENTS, CONSULTANTS, PARENTS, AFFILIATES, SUCCESSORS, ASSIGNS, OR SERVICE/CONTENT PROVIDERS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING FROM, OR DIRECTLY OR INDIRECTLY RELATED TO, THE USE OF, THE INABILITY TO USE, OR RELIANCE ON THE SITE OR THE SERVICE, OR THE CONTENT, MATERIALS AND FUNCTIONS RELATED THERETO, INCLUDING, WITHOUT LIMITATION, LOSS OF REVENUE, ANTICIPATED PROFITS, BUSINESS, PROGRAMS, DATA OR INFORMATION, EVEN IF TEXTOSCOPIO OR SUCH PERSON OR ENTITY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE FORM OF ACTION.

15. Termination
You may stop using the Service at any time. To cancel a paid subscription, see Section 5. You agree that Textoscopio, in its sole discretion and without notice or liability to You, may terminate Your use of, or access to, the Site or any part of the Service at any time if Textoscopio believes in good faith that You have violated or acted inconsistently with these Terms or any applicable law, rule or regulation, or that You have engaged in conduct that Textoscopio determines to be inappropriate or unacceptable.
On termination, Your right to use the Service ceases. You remain liable for fees accrued before termination. Sections that by their nature should survive termination (including Sections 6, 7, 9.3, 12, 13, 14 and 16) will survive.
16. Copyright infringement
Textoscopio respects the intellectual property rights of others and asks that Users do the same. Textoscopio generally does not monitor or pre-screen content or information submitted to the Service, although Textoscopio reserves the right to do so in its sole discretion. If You believe a User of the Service is infringing Your copyright, please notify Textoscopio in writing at the following address or email:

Email: info@thomasgaultier.com · Phone: +351 916441499
Each notification must include: (i) a physical or electronic signature of a person authorised to act on behalf of the owner of an exclusive right that is allegedly infringed; (ii) identification of the copyrighted work claimed to have been infringed; (iii) identification of the material that is claimed to be infringing and information reasonably sufficient to permit Textoscopio to locate it; (iv) contact information for the complaining party; (v) a statement that the complaining party has a good faith belief that use of the material is not authorised by the copyright owner, its agent, or the law; and (vi) a statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.
17. Governing law and dispute resolution
The laws applicable to the interpretation of these Terms shall be the laws of Portugal, without regard to its conflicts of laws provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Lisbon, Portugal.
You also agree that, in the event any dispute or claim arises out of or relating to Your use of the Site or the Service, You and Textoscopio will attempt in good faith to negotiate a written resolution of the matter directly. If the matter remains unresolved for forty-five (45) days after written notification (via certified mail, courier with delivery confirmation, or email with read receipt to the contact addresses in these Terms), it will be deemed a “dispute”, and all parties shall join in mediation services in Lisbon, Portugal with a mutually agreed mediator in any attempt to resolve the dispute. Should You file any arbitration claims, or any administrative or legal actions, without first having attempted to resolve the matter by mediation, then You agree that You will not be entitled to recover attorneys’ fees, even if You may have been entitled to them otherwise.
Nothing in this Section limits the mandatory rights of consumers under the laws of their country of residence. A consumer in the European Union may bring proceedings in the courts of their country of habitual residence or refer the dispute to the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
18. Miscellaneous
- These Terms, the Privacy Policy, and any additional agreement regarding the Service between You and Textoscopio constitute the entire agreement between You and Textoscopio with respect to Your access and use of the Site and the Service, and supersede all prior and contemporaneous agreements between You and Textoscopio. The White Paper click-through licence forms part of this agreement when You first download the White Paper.
- If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, that provision will be construed in a manner consistent with applicable laws to reflect, as nearly as possible, the original intentions of the parties, and the remaining provisions shall remain in full force and effect. Textoscopio’s failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver.
- Neither party is liable for any failure or delay in performance to the extent caused by events outside its reasonable control, including natural disasters, war, terrorism, civil unrest, government action, pandemic, internet or telecommunications failure, or failure of upstream service providers.
- You may not assign or transfer Your rights or obligations under these Terms without Textoscopio’s prior written consent. Textoscopio may assign these Terms to a successor in connection with a merger, acquisition, or sale of assets, with notice to You.
